Driving Lesson Terms and Conditions
These terms and conditions apply to driving lessons and courses booked with Driving School Bradford. By booking or attending a lesson, you agree to these terms.
Lesson Bookings and Payments
Driving lessons and courses must be paid for on or before the agreed payment date. Your instructor may require payment in advance to secure your booking.
Lesson prices will be confirmed when you book. Any outstanding payment must be paid before further lessons can take place.
Block-booking payments may only be used by the pupil named when the booking was made and cannot normally be transferred to another person without prior agreement.
Cancelling or Rearranging a Lesson
You must give at least 48 hours’ notice if you wish to cancel or rearrange a driving lesson.
If less than 48 hours’ notice is provided, or you do not attend the lesson, you may be charged the full lesson fee. This is because the instructor may be unable to offer the reserved time to another pupil.
Cancellation charges will be applied fairly and will reflect the circumstances and any loss caused by the late cancellation.
You are responsible for checking the date, time and meeting location of each lesson.
Late Arrival
If you arrive late, the lesson will normally finish at the originally agreed time, and the full lesson price will remain payable.
If the instructor is late, reasonable efforts will be made to provide the full lesson time or add the missing time to a future lesson.
Block Bookings and Refunds
If you cancel a block booking, any refund will be calculated after deducting:
- The cost of lessons already taken, recalculated at the standard lesson rate where appropriate.
- Any reasonable costs or losses directly resulting from the cancellation.
- Any properly disclosed and reasonable administration charge, where applicable.
Any remaining balance will then be refunded.
Refunds are not automatically refused simply because lessons were purchased as a block booking. Each request will be considered fairly and in accordance with applicable consumer law.
If you pass your practical driving test before using all your prepaid lessons, the lessons already taken may be recalculated at the normal lesson rate. Any remaining balance will then be refunded, subject to reasonable deductions.
Extended Breaks and Loss of Contact
Please keep in regular contact with your instructor.
If you do not arrange a lesson or respond to messages for more than three weeks, your regular lesson time may be offered to another pupil.
Prepaid lesson credit will not automatically be lost solely because you have not made contact. However, long periods of inactivity may affect lesson availability, prices or the instructor’s ability to continue providing tuition.
Any expiry period applying to a prepaid course must be clearly communicated when the course is purchased.
Fitness to Drive
You must be medically fit and legally entitled to drive.
You must tell your instructor about any medical condition, medication or change in circumstances that could affect your ability to drive safely.
A lesson will be cancelled, and the full fee may be charged, if the instructor reasonably believes you are unfit to drive because of:
- Alcohol or illegal drugs.
- Medication that affects safe driving.
- Tiredness, illness or another medical condition.
- Any other substance or condition that makes driving unsafe.
You must meet the legal eyesight requirement and bring any glasses or contact lenses needed for driving.
Provisional Driving Licence
You must hold a valid UK provisional or full driving licence appropriate for the tuition being provided.
You must inform your instructor immediately if your licence is lost, expired, revoked, suspended or changed.
Your instructor may ask to check your licence before your first lesson and at reasonable intervals afterwards.
Conduct and Safety
You must follow reasonable safety instructions given by your instructor.
Abusive, threatening, discriminatory or dangerous behaviour will not be accepted. A lesson may be stopped if your behaviour places you, the instructor or another road user at risk.
The full lesson fee may remain payable if a lesson is ended because of the pupil’s unsafe or unacceptable conduct.
Practical Driving Tests
The use of a driving-school vehicle for a practical test is subject to the instructor’s agreement.
The instructor may refuse the use of the vehicle if they reasonably believe:
- You are not ready to take the test safely.
- Your driving does not meet the required standard.
- You have not taken sufficient recent lessons with the instructor.
- The test booking has not been discussed and agreed in advance.
- You have ignored reasonable advice concerning your readiness for the test.
Where reasonably possible, the instructor will give you sufficient notice and explain the reason for the decision.
Cancellation of a Practical Test
If the driving-school vehicle becomes unavailable because of mechanical failure or instructor illness, reasonable efforts will be made to provide another suitable vehicle or instructor.
If this is not possible, Driving School Bradford will refund any payment made directly to us for services we cannot provide. Liability for other losses will be considered in accordance with applicable law and the individual circumstances.
If the Driver and Vehicle Standards Agency (DVSA) cancels your test, you should apply to the DVSA for any compensation or reimbursement available.
Lessons booked for the day of a cancelled test remain subject to the 48-hour cancellation policy where the instructor remains available to provide the lesson. You may be able to claim certain reasonable costs from the DVSA, depending on the reason for cancellation.
Instructor Cancellation
Your instructor may cancel or rearrange a lesson because of illness, severe weather, unsafe road conditions, vehicle problems or another situation outside their reasonable control.
You will not be charged for a lesson cancelled by the instructor. Any amount already paid for that lesson will be transferred to another agreed date or refunded.
Cooling-Off Rights for Online or Telephone Bookings
Where a driving course is booked online or by telephone, you may have a legal right to cancel within 14 days.
If you ask for lessons to begin during this period, you may be required to pay for lessons already provided before you cancel. Your statutory consumer rights are not affected by these terms.
